Abstract

The article examines the theoretical contributions of Oliveira Vianna to the development of authoritarian constitutional thought. Drawing from a relatively unknown text by the author, published only in 1991 and titled "The Guarantees of the Judiciary in Authoritarian Regimes (Article 177 of the Federal Constitution of 1937)," the formulation of authoritarian constitutional principles will be scrutinized. The article further analyses Vianna's conception of an autonomous judiciary within an authoritarian regime, his notion of "moderate" authoritarianism, which distinguishes between arbitrariness and authoritarianism, and, finally, his reflections on "authoritarian democracy."
