Methodological Reflections and Comparisons in Constitutional Law

The field of contemporary comparative law gains greater relevance in private law from the French Civil Codification of 1804 on, and in constitutional law after the Second World War. We show, however, that comparativism in the legal field has older historical roots. In the first part of the article, we reflect on central methodological issues and analyze the origins and main characteristics of comparativism, in addition to addressing the themes of macrocomparison and micro-comparison. We also critically analyze the supposed modernizing function of comparative law within the frame of developmental reflections and pluralism. Without disregarding the specifics of public law, we argue in the second part of the article that the contemporary field of comparative constitutional law benefits greatly from the analyses promoted by the broader field of comparative law and from discussions originally raised under the influence of private law.
