Abstract

When the 1824 Constitution used the term "literate judges," it referred to the prior knowledge that the legislator possessed about the social and institutional practices that existed in Brazil at that time. These practices, in turn, derived from some past and some real matrix, from which the expression "literate judges" was formed. During the transition from colonial Brazil to Empire, this expression was used once again by legislators to define the magistrate who was qualified to pursue all ranks of the judicial career that had been inaugurated in the country, up to serving on the higher courts, as the Supreme Court of Justice, its maximum instance. Thefore, understanding the country's founders’ lexical universe is indispensable to apprehend the historical gaps they left behind.

    Graduated in Law from the Getúlio Vargas Foundation Law School, FGV - Direito Rio, with supplementary training through the Program in International Relations in the Contemporary World, at the Center for International Relations of the Getúlio Vargas Foundation, an integral part of the Center for Documentation of Contemporary Brazilian History, CPDOC - Rio. Participated in an exchange program and undergraduate studies extension program at the Faculty of Law of the University of Coimbra, in Portugal. Master's student in Theory and Philosophy in the Postgraduate Program in Law at the State University of Rio de Janeiro - UERJ. Researcher at the Research Center in Law and Social Sciences (DECISO) of the Institute of Social and Political Studies of the State University of Rio de Janeiro, IESP-UERJ.
